General Terms and Conditions

Article 1. Definitions

In these General Terms and Conditions, the following is understood to mean:

Hairstudio Adonize: located at Radioweg 59, 1098 NG Amsterdam.

Consumer: The natural person who, other than in the exercise of his profession or business, makes use of the services of Hairstudio Adonize.

Agreement: The agreement for a hair and scalp treatment and/or the supply of related products in the field of hair and scalp care.

Disputes Committee: The Personal Care Disputes Committee, Bordewijklaan 46, P.O. Box 90600, 2509 LP The Hague. Telephone number 070-3105310

Trade association: ANKO, Royal Dutch Hairdressers' Organization

Article 2. Applicability

These General Terms and Conditions apply to the conclusion and execution of all hair and scalp treatments between Hairstudio Adonize and the consumer.

Article 3. Formation of the agreement

The agreement is concluded after the consumer has requested a hair and/or scalp treatment and Hairstudio Adonize has indicated that it will perform that treatment.

  • At the time of the conclusion of the agreement between the consumer and Hairstudio Adonize, Hairstudio Adonize will send an email confirmation to the consumer stating the agreed treatment(s). The price(s) as applicable on the date on which the agreed treatment(s) takes place are/are stated in the price list. Price list changes reserved.
  • If the client is unable to attend, they must notify Hairstudio Adonize at least 24 hours in advance and exclusively by telephone or via the link (cancel appointment) included in the confirmation email. Failure to comply with this will result in Hairstudio Adonize charging half of the scheduled treatment(s). Cancellation via email and/or by any other means will NOT be accepted.
  • The cancellation conditions, as stated in Article 7 of these terms and conditions, apply and are made known to the consumer before the agreement is concluded.

Article 4. Obligations of the entrepreneur

  • Hairstudio Adonize guarantees that the work performed by it conforms to the agreement and is carried out with good and careful craftsmanship and using sound materials and equipment.
  • Hairstudio Adonize informs the consumer about the nature and scope of the treatment, the reasonably expected results, and the possible risks associated with the treatment. Hairstudio Adonize asks the consumer for information relevant to properly perform the treatments.
  • Hairstudio Adonize is deemed to operate in accordance with applicable laws and regulations and the state of the art, as reflected, among other things, in the relevant industry code issued by the HBA.
  • Hairstudio Adonize will not perform any action that falls outside its professional competencies. This may mean that it refrains from treatment in certain cases.

Article 5. Obligations of the consumer

  • In the event of any specific wishes, the consumer must inform Hairstudio Adonize prior to entering into the agreement.
  • The consumer has the duty to provide Hairstudio Adonize with all requested and necessary information required for the proper execution of the agreed treatment.
  • The consumer is personally responsible for informing Hairstudio Adonize whether he/she is allergic to certain products and/or ingredients. Hairstudio Adonize offers the consumer the opportunity to have an allergy test performed by Hairstudio Adonize free of charge and at least 48 hours before the start of the treatment booked at Hairstudio Adonize. Hairstudio Adonize cannot be held liable in any way for any allergic reaction(s) resulting from hair and/or scalp treatment(s) offered by Hairstudio Adonize.

Article 6. Payment

  • Payments to Hairstudio Adonize must be made in cash or digitally using a generally accepted means of payment in Europe.
  • For one or more treatment(s), Hairstudio Adonize may require the consumer to make an advance payment of up to fifty percent of the total treatment sum. The remaining part of the treatment sum will be invoiced after completion of the treatment(s) and must be paid immediately.

Article 7. Cancellation Policy

  • The consumer may change or cancel the scheduled treatment appointment free of charge at any time up to at least 24 hours in advance. After this 24-hour period, 50% of the reserved treatment appointment will be charged.
  • Treatment appointments can only be changed or cancelled by telephone. The following telephone number applies: 020-6929264, or by notifying Hairstudio Adonize via the "cancel appointment" or "reschedule appointment" link in the confirmation email.
  • In the event of no-show appointments (failure to show up without any notice for the booked treatment appointment), Hairstudio Adonize is entitled to charge the consumer 50% of the booked treatment.
  • In the event of cancellation of a previously booked and prepaid treatment, Hairstudio Adonize will refund the prepaid treatment amount within 14 days.
  • When changing treatments that have already been booked and paid for in advance, the prepaid rate will continue to apply and, if necessary, be adjusted for the modified order in the salon after the treatment.

Article 8. Liability

  • The consumer is liable to Hairstudio Adonize for damage suffered by Hairstudio Adonize caused by a shortcoming attributable to the consumer.
  • Hairstudio Adonize is liable to the consumer for damage resulting from a shortcoming attributable to Hairstudio Adonize or a person in its service or an intern.

Article 9. Complaints

  • It is strongly recommended that shortcomings be submitted to Hairstudio Adonize in writing or electronically immediately after they are discovered or could have been discovered. Waiting within 2 weeks or waiting too long to file a complaint may have adverse consequences for the consumer's evidentiary position.
  • Hairstudio Adonize shall investigate complaints adequately. Hairstudio Adonize will rectify any shortcomings within a reasonable period, if possible, unless this cannot be reasonably expected of it given the circumstances.
  • If the complaint cannot be resolved satisfactorily through mutual consultation, a dispute arises that may be submitted to the Disputes Committee.

Article 10. Dispute Resolution

  • Disputes between the consumer and Hairstudio Adonize regarding the formation or execution of the agreements may be submitted to the Disputes Committee www.degeschillencommissie.nl by both the consumer and Hairstudio Adonize.
  • A dispute will only be considered by the Disputes Committee if the consumer has first submitted their complaint to Hairstudio Adonize.
  • After the complaint has been filed with Hairstudio Adonize, the dispute must be submitted to the Disputes Committees no later than three months after it arose.
  • When the consumer submits a dispute to the Disputes Committee, Hairstudio Adonize is bound by this choice. If Hairstudio Adonize wishes to submit a dispute to the Disputes Committee, it must ask the consumer to state within five weeks whether he or she agrees to this. Hairstudio Adonize must also announce that, after the expiry of the aforementioned period, it will consider itself free to submit the dispute to the court.
  • The Disputes Committee renders its decision in accordance with the provisions of the regulations applicable to it. The decisions of the Disputes Committee are made on the basis of those regulations by way of binding advice. The regulations will be sent upon request. A fee is payable for the handling of a dispute. The amount thereof is determined by the Disputes Committee.
  • Only the court or the aforementioned Disputes Committee is authorized to hear disputes.

Article 11. Guarantee of performance

  • The Dutch employers' organization in the hairdressing industry, ANKO, guarantees compliance with the binding opinions regarding its members, unless the member decides to submit the binding opinion to the court for review within two months of its dispatch. The guarantee is reinstated if the binding opinion is upheld after review by the court and the judgment confirming this has become final and binding.
  • The guarantee to the consumer is limited to a maximum amount of €7,500 per binding opinion. For the remainder, the consumer is offered the option to transfer their claim to ANKO, after which this organization will seek payment thereof in its own name through legal proceedings to satisfy the consumer.
  • ANKO provides no guarantee of performance if, before the consumer has met the formal intake requirements stipulated for the handling of the dispute—payment of the complaint fee, return of the completed and signed questionnaire, and any deposit payment—one of the following situations applies:
    • The member has been granted a suspension of payments;
    • The member has been declared bankrupt;
    • The business activities have been effectively terminated. Determinant for this situation is the date on which the termination of business is registered in the Trade Register of the Chamber of Commerce or an earlier date on which ANKO can demonstrate that the business activities were effectively terminated.

Article 12. Deviations

  • Individual deviations from these General Terms and Conditions, including individual additions, must be recorded in writing or electronically between Hairstudio Adonize and the consumer. Deviations are only possible if they are to the benefit of the consumer.
